Pursuant to section 239(2) of the Municipal Act, 2001, Council will enter into Closed Session at 5:00 pm to address the following item:


Item I - Extreme Weather Events - Section 239(2)(f) - advice that is subject to solicitor-client privilege, including communications necessary for that purpose.

  • Recommended Action

    Pursuant to section 239 of the Municipal Act, 2001, Council enter into Closed Session.

We acknowledge the Three Fires Confederacy (Ojibwe, Potawatomie and Odawa) and the Traditional ancestral, unceded territory of Caldwell First Nation; the original people of Point Pelee, Pelee Island and its surrounding waters. We recognize and respect the First Nations who are stewards of the land and waters of Turtle Island and who have embraced this stewardship since time immemorial. We would also like to acknowledge all the moccasins who have walked lands of Turtle Island.

When a member of Council has any pecuniary interest, direct or indirect, in any matter which is the subject of consideration at this Meeting of Council (or that was the subject of consideration at the previous Meeting of Council at which the member was not in attendance), the member shall disclose the pecuniary interest and its general nature, prior to any consideration of the matter.

Pursuant to Section 239(2) of the Municipal Act, 2001, Council entered into Closed Session at 8:20 pm on November 27, 2023 to address the following items:


Item I - Fire Department Update heard under Section 239(2)(d)  There is nothing further to report.


Item II - Cyber Security Update heard under Section 239(2)(a)  There is nothing further to report.


Item III - Litigation Settlement heard under Section 239(2)(e) and (f)  There is nothing further to report.

  • Recommended Action

    That Council APPROVE the Strategic Plan, “A 2040 Vision for Council”.

  • Recommended Action
    1. That Zoning By-law amendment application ZBA-2023-18 to amend the zoning on the subject parcels from Residential Zone 2 Rural/Urban- holding, “R2.2(h)” to Residential Zone 2 Rural/Urban, “R2.2” BE APPROVED; and,
    2. That By-law 87-2023 being a By-law to amend By-law No. 1-2014, the Comprehensive Zoning By-law for the Town of Kingsville be taken as having been read three times and finally passed and the Mayor and Clerk BE AUTHORIZED to sign the same.

       

  • Recommended Action

    That Administration BE DIRECTED to renew the Town’s insurance program with Intact Public Entities Inc. for a one year period beginning January 1, 2024.

  • Recommended Action

    That Administration BE DIRECTED to:

    1. Prepare a By-law establishing a compliance and inspection program for private greenhouse wastewater systems connected to public infrastructure, inclusive of an appropriate fee schedule and fines for non-compliance; and,
    2. Prepare a By-law, or amendments to existing By-laws, for regulating the use of public and private sewer systems, inclusive of an appropriate fee schedule and fines for non-compliance.

  • Recommended Action

    That Administration BE DIRECTED to prepare a report to license and provide oversight of large holiday light displays and shows, for the purpose of controlling and managing nuisances to neighbours, with the holiday season of November and December 2024.

  • Recommended Action
    1. That By-law 076-2023 BE APPROVED which extends the contract between the Town of Kingsville, Municipality of Leamington and Essex County K9 Services for the provision of Animal Control Services, commencing January 1, 2024.
    2. That Council APPROVE the Town of Kingsville’s approximate portion of the animal control services contract extension of $38,000 plus HST per year for a 3 year term and a cost of $70 plus HST for each wildlife removal call.

WHEREAS By-Law 10-2004, to regulate the discharge of firearms and bows within the Town of Kingsville, establishes areas in which the discharge of firearms and bows are permitted or not permitted and is based on traditional urban and rural areas;


WHEREAS this By-law is now 20 years old and there has been substantial residential growth throughout Kingsville;


WHEREAS there are evolving needs and challenges in our communities regarding the discharge of firearms and bows;


WHEREAS there have been advancements in firearm technology, changes in recreational shooting practices, and evolving demographics for hunting and sport shooting;


WHEREAS the By-law needs updated to balance between the rights of individuals engaging in recreational shooting or hunting and the peace and security of our residential neighborhoods;


THEREFORE, I am submitting this notice of motion to request that Council directs Administration to commence the process of reviewing and amending By-law 10-2004 which shall include public consultation.

WHEREAS Council supported short term rental review in our recent Strategic Plan discussions;


AND WHEREAS priorities for 2024 are still to be determined;


AND WHEREAS work to implement the approved licensing program for Rooming and Boarding Houses is still to be completed;


THEREFORE, Council directs Administration to obtain public input through an online survey.

Clerk's Note: The By-laws for drainage works that immediately follow originally formed part of By-law 72-2023 which received 2 readings at the November 27, 2023 Regular Meeting. For housekeeping reasons, By-law 72-2023 has been split and a new Provisional By-law has been drafted for each separate drain.

By-law 72-2023 - Being a By-law to provide for the bridge extension over the Sedgewick Drain for the Ministry of Transportation Highway 3 Widening Project at a total estimated cost of $495,000 in the Town of Kingsville, in the County of Essex


By-law 78-2023 - Being a By-law to provide for the bridge extension over the 7th Concession Drain for the Ministry of Transportation Highway 3 Widening Project at a total estimated cost of $840,000 in the Town of Kingsville, in the County of Essex


By-law 79-2023 - Being a By-law to provide for the bridge extension over the Boose Drain for the Ministry of Transportation Highway 3 Widening Project at a total estimated cost of $785,000 in the Town of Kingsville, in the County of Essex


By-law 80-2023 - Being a By-law to provide for the bridge extension over the East Branch of No 47 Drain for the Ministry of Transportation Highway 3 Widening Project at a total estimated cost of $570,000 in the Town of Kingsville, in the County of Essex


By-law 81-2023 - Being a By-law to provide for the culvert extension over the North Branch of the East Branch of No 47 Drain for the Ministry of Transportation Highway 3 Widening Project at a total estimated cost of $220,000 in the Town of Kingsville, in the County of Essex


By-law 82-2023 - Being a By-law to provide for the culvert extension over the Wallace Fox Drain for the Ministry of Transportation Highway 3 Widening Project at a total estimated cost of $385,000 in the Town of Kingsville, in the County of Essex


By-law 83-2023 - Being a By-law to provide for the culvert replacement over the Melville Bruner Drain Extension for the Ministry of Transportation Highway 3 Widening Project at a total estimated cost of $640,000 in the Town of Kingsville, in the County of Essex


By-law 84-2023 - Being a By-law to provide for the upstream relocation of the East 3rd Concession Drain for the Ministry of Transportation Highway 3 Widening Project at a total estimated cost of $25,000 in the Town of Kingsville, in the County of Essex


By-law 85-2023 - Being a By-law to provide for the relief drain for the Gilboe Drain for the Ministry of Transportation Highway 3 Widening Project at a total estimated cost of $150,000 in the Town of Kingsville, in the County of Essex


By-law 86-2023 - Being a By-law to provide for the realignment of the Lane Drain and Highway Culvert Replacement for the Ministry of Transportation Highway 3 Widening Project at a total estimated cost of $954,000 in the Town of Kingsville, in the County of Essex


 


That By-laws 69-2023, 76-2023, 77-2023, and 88-2023 be taken as having been read three times and finally passed and the Mayor and Clerk BE AUTHORIZED to sign same:


By-law 69-2023 - Being a By-law to designate certain property, including land and building, known as The Colonel James King House (101 Mill Street West, Kingsville) as being of cultural heritage value or interest under the provisions of the Ontario Heritage Act, R.S.O. 1990, c. O.18 as amended (Housekeeping By-law)


By-law 76-2023 - Being a By-law authorizing the entering into of an Animal Control and Pound Services Agreement with The Corporation of the Municipality of Leamington and with Essex County K9 Services


By-law 77-2023 - Being a By-law to appoint building inspector Laurie Bilokraly


By-law 88-2023 - Being a By-law to confirm the proceedings of the Council of the Corporation of the Town of Kingsville at its December 6 and December 11, 2023 Meeting of Council
