In light of the December 5th, 2021 Letter of Instruction from Dr. Nesathurai, Medical Officer of Health for Windsor-Essex County, Council has returned to electronic participation until further notice.  Members of the public can continue to view the meeting via livestream at www.kingsville.ca/livestream.

We acknowledge the Three Fires Confederacy (Ojibwe, Potawatomie and Odawa) and the Traditional ancestral, unceded territory of  Caldwell First Nation; the original people of Point Pelee, Pelee Island and its surrounding waters. We recognize and respect the First Nations who are stewards of the land and waters of Turtle Island and who have embraced this stewardship since time immemorial. We would also like to acknowledge other nearby First Nations Communities and First Nations across Turtle Island.

When a member of Council has any pecuniary interest, direct or indirect, in any matter which is the subject of consideration at this Meeting of Council (or that was the subject of consideration at the previous Meeting of Council at which the member was not in attendance), the member shall disclose the pecuniary interest and its general nature, prior to any consideration of the matter.

    1. That the sole source hiring of Janice Forsyth, of Foresight Management Consulting, to conduct an organization-wide Customer Service Review BE APPROVED at the cost of $15,000 (or $150.00 per hour) plus applicable taxes.

    1. That site plan amendment application SPA/03/2021 for new warehouse/cooler space, enclosure of an existing loading and open area, new bunkhouse, separate Quonset storage building and additional storm water management pond on lands located at 1545 Kratz Side Road BE APPROVED subject to the conditions and requirements outlined in the amending site plan agreement; and,

    2. The Mayor and Clerk BE AUTHORIZED to sign the agreement and register said agreement on title.

    1. That tax reductions totaling $3,801.30 for the 2021 taxation year BE AUTHORIZED.

    2. The Mayor and Clerk BE AUTHORIZED to sign same.

    1. That Administration BE DIRECTED to renew the Town’s insurance program with Intact Public Entities Inc. for a one year period beginning January 1, 2022.

  • Recommended Action
    1. That the renewal of the Risk Management Services Agreement with the Essex Region Conservation Authority for the period Jan 01 2022 – Dec 31, 2024 BE APPROVED; and,

       

    2. The Mayor and Clerk BE AUTHORIZED to execute the Source Protection Plan Part IV Enforcement Transfer Agreement with the Essex Region Conservation Authority.

G. A. Plancke, Director of Infrastructure and Engineering

  • Recommended Action

    1. That the repurposing of the Unico Community Centre for relocation of the Planning and Building divisions of the Community and Development Services Department BE APPROVED; and,

    2. The allocation of $250,000 from Facilities Lifecycle and Building Reserves to engage a consultant to complete detailed design and tendering to support design, construction, permits and contingencies to complete the renovations BE APPROVED.

  • Recommended Action
    1. That By-law 100-2021 being a by-law to designate 183 Main Street East in the Town of Kingsville to be of cultural heritage value or interest pursuant to section 29 of the Ontario Heritage Act be taken as having been read three times and finally passed and the Mayor and Clerk BE AUTHORIZED to sign same.

  • Recommended Action
    1. That an amending agreement for the provision of Police Services under Section 10 of the Police Services Act between Her Majesty the Queen in Right of Ontario as represented by the Ministry of the Solicitor General and the Town of Kingsville BE EXTENDED for a period of one year; and,

    2. By-law 101-2021 being a by-law to authorize the extension agreement be taken as having been read 3 times and finally passed and the Mayor and Clerk BE AUTHORIZED to sign same.
  • Recommended Action

    Whereas the Council of the Town of Kingsville recognizes that safety and well-being of residents across Windsor-Essex remain critically important with the current state of emergency and pandemic around Covid-19 and respects that appropriate safety protocols are needed to limit the exposure of the virus to citizens,

    AND Whereas health and well-being of communities must include considerations for mental health and economic health for residents, schools, municipalities, and small business owners who have struggled through lockdowns,

    AND Whereas these considerations currently allow for citizens to cross the border to attend sporting events, restaurants and concerts without capacity restrictions;

    AND Whereas residents are also able to attend local sporting events, shop in big box stores locally and neighbouring Health Unit jurisdictions also allow for continuance of business in the service industry without introducing economically challenging capacity limits;

    NOW Whereas the Windsor Essex County Health Unit (WECHU) issued an updated Letter of Instruction on December 5th, 2021 which addresses new limits on gatherings and specifically imposes a limit to the indoor capacity of bars and restaurants to be no greater than 50 percent of their total capacity;

    AND Whereas Workplaces/businesses are currently required under the Reopening Ontario Act 2020 (A Flexible Response to COVID-19) to keep a list of attendees (visitors, patrons, clients) to the workplace including name and contact information must provide the list to the WECHU within immediately request from a WECHU official,

    AND Whereas area restaurants and bars must ensure a process for proof of vaccination status is in place where applicable, as per instructions under the Reopening Ontario Act, 2020.

    AND Whereas Windsor- Essex residents have nearly an 80 per cent vaccination rate,

    THEREFORE, the Town of Kingsvillle believes sufficient requirements are in place regarding gathering limitations and is greatly concerned for the creation of an unlevel playing field for restaurants and bars who represent the only targeted businesses in this reduction of capacity to 50% as it impairs their economic health at this critical time of year,

    AND Furthermore, Kingsville Council supports that the WECHU immediately withdraw this instruction for restaurants and bars as their risk is arguably no greater than any other small business and likely less than larger businesses, and sporting venues.

    AND Furthermore, Kingsville Council joins the call and voices from the restaurant sector that encourage WECHU to fully enforce the current requirements of their sector under the Reopening Ontario Act to ensure those who are not following the regulation are addressed without impacting the balance of the sector who are in compliance.

    A copy of this resolution is hereby directed to be provided to the Acting Medical Officer of Health, Dr. Shanker Nesathurai, the directors of the Windsor Essex County Health Unit Board, as well as circulated to all member municipalities in Windsor-Essex County including the County of Essex and City of Windsor, the Premier of Ontario, and each Windsor-Essex MPP.

That a Resolution of Thanks (in the form provided and attached) be approved by Council and that a copy be provided to the local Community Police Services Board, the Fire Department, the EMS and each of the Town's school crossing guards.
