We acknowledge the Three Fires Confederacy (Ojibwe, Potawatomie and Odawa) and the Traditional ancestral, unceded territory of Caldwell First Nation; the original people of Point Pelee, Pelee Island and its surrounding waters. We recognize and respect the First Nations who are stewards of the land and waters of Turtle Island and who have embraced this stewardship since time immemorial. We would also like to acknowledge all the moccasins who have walked lands of Turtle Island.

  • Recommended Action
    1. That consent application B-2024-5, to sever an existing dwelling, deemed surplus to the needs of the applicants’ farming operation with an area of 1.97 ac (0.80 ha) lot shown as Part 1 on the applicants’ sketch, known as 1515 Road 4 W/ County Rd 18, in the Town of Kingsville, BE APPROVED, subject to the following conditions:

       

      1. Prior to consent being endorsed on the deeds the property owners are to execute an agreement for drainage apportionment due to lands severance or sale approved by the Municipality for each parcel being severed. Drainage Apportionment Request, 12R plan shall be submitted to the Municipality a minimum of one month prior to the stamping of the deeds.

         

      2. Prior to consent being endorsed on the deeds a lot grading plan acceptable to the municipality, shall be provided by the applicant to serve the lands being conveyed, and the lands being retained, with the cost of such drainage being solely at the expense of the applicant. Lot Grading Plans shall be submitted to the Engineering Department a minimum of three months prior to the stamping of the deeds.

         

      3. That the applicant provide confirmation to the satisfaction of the Town the location of any existing septic systems in relation to the revised lot line locations.

         

      4. That the necessary deed(s), transfer or changes be submitted electronically, signed and fully executed, including a copy of the reference plan, prior to certification.

         

      5. That each parcel have access to Road 4 W/ County Rd 18 and the applicant acquire an entrance or encroachment permit for access to the retained farm parcel from the County of Essex.

         

      6. The conditions imposed above shall be fulfilled by March 11, 2026 or this application shall be deemed to be refused in accordance with Section 53(41) of the Planning Act.

         

    2. And that By-law 20-2024 being a By-law to amend the Comprehensive Zoning By-law 1-2014 for the Town of Kingsville, to amend the zoning on the retained farm parcel municipally known as V/L Road 2 W,, from ‘General Agricultural (A1)’ to ‘Agricultural - Restricted (A2)’ BE APPROVED; and the Mayor and Clerk BE AUTHORIZED to sign same.
  • Recommended Action
    1. That Council APPROVE consent applications B-2024-7 to create one (1) new lot located at 291 Main Street East, in the Town of Kingsville, subject to the following conditions:

       

      1. A reference plan be deposited in the registry office, and an electronic copy be provided to the Secretary-Treasurer of Committee of Adjustment at the Town of Kingsville for the file;

         

      2. That reciprocal easements for access must be registered on title in favour of the severed parcel (created lot) from 271, 281, 291 Main St. E.

         

      3. That mutual easements be registered on title between the retained (retained lot) and severed parcels (retained lot) for services.

         

      4. The conditions imposed above shall be fulfilled by March 11, 2026 for this application shall be deemed to be denied in accordance with Section 53(41) of the Planning Act.

         

    2. And that By-law 24-2024 being a By-law to amend the Comprehensive Zoning By-law 1-2014 for the Town of Kingsville, to amend the zoning on the subject parcel municipally known as severed parcel (created lot), from ‘General Commercial (C4)’ to ‘General Commercial Exception 8 (C4-8)’ BE APPROVED; to permit:

       

      1. Elimination of the required frontage from 15.0 m (50.0 ft) to 0.0 m (0.0 ft).

         

  • Recommended Action

    That the tender for the new Jamis Drain and Branches BE AWARDED to Clarke Construction Inc. in the amount of $339,221 (excluding HST) and that all costs related to this project be borne by the owner of parcels 1-7 under Roll # 290-38900.

  • Recommended Action
    1. That the purchase of one (1) 2024 Western Star 47X Tandem Axle Dump Truck/Snow Plow at the cost of $383,775, plus HST BE APPROVED; and,

       

    2. That the purchase of one (1) 2025 Freightliner FL114SD+ Tandem Axle Dump Truck/Snow Plow at the cost of $369,275, plus HST BE APPROVED.

       

  • Recommended Action

    That Administration BE DIRECTED to enter into an Agreement with the Kingsville Community Centre for the provision of programs and services for seniors known as a Kingsville Seniors Active Living Centre (“SALC”), and in accordance with the funding and requirements stipulated by the Ministry of Seniors and Accessibility for the Province of Ontario.

  • Recommended Action

    That Council RECONSIDER By-law 68-2023 (which was approved by Council on November 27, 2023), and which prohibited the illumination of Commercial Signs outside or on buildings between the hours of 11pm and 7am, unless the building contains a business that is open for retail sales to the general public between those hours.

    That By-law 26-2024 being a By-law to confirm the proceedings of the Council of the Corporation of the Town of Kingsville at its March 11, 2024 Regular Meeting of Council, receive three readings and finally pass.

    Pursuant to section 239(2) of the Municipal Act, 2001, Council will enter into Closed Session to address the following items:

    Item I - Heritage Designations to be heard under Section 239(3.1) being educating or training members of the council, local board or committee; and, Section 239(2)(f) advice that is subject to solicitor-client privilege, including communications necessary for that purpose;

    Item II - Committee Appointments to be heard under Section 239(2)(c) being personal matters about an identifiable individual, including municipal employees;

    Item III - Remark Agreement to be heard under Section 239(2)(c) being a proposed or pending acquisition or disposition of land by the municipality; and, Section 239(2)(f) advice that is subject to solicitor-client privilege, including communications necessary for that purpose;

    *Item IV - Labour Relations Matter to be heard under Section 239(2)(d) being labour relations or employee negotiations; and, Section 239(2)(k) being a position, plan, procedure, criteria, or instruction to be applied to negotiations;

    *Item V - Water Meter Installations to be heard under Section 239(2)(a) being the security of the property of the municipality; Section 239(2)(b) being personal matters about an identifiable individual, including municipal employees; and, Section 239(2)(f) being advice that is subject to solicitor-client privilege including communications necessary for that purpose;

    *Item VI - Animal Control Matter to be heard under Section 239(2)(b) being personal matters about an identifiable individual, including municipal employees; and, Section 239(2)(f) being advice that is subject to solicitor-client privilege including communications necessary for that purpose;

    *Item VII - Employee Matter Pertaining to a Local Board to be heard under Section 239(2)(b) being personal matters about an identifiable individual, including municipal employees; and, Section 239(2)(f) being advice that is subject to solicitor-client privilege including communications necessary for that purpose; and,

    *Item VIII - Negotiations Respecting Medical Service Provision in Kingsville to be heard under Section 239(2)(k) being a position, plan, procedure, criteria, or instruction to be applied to negotiations.
