Deputy Mayor Queen called the Regular Meeting to order at 6:00 p.m. with all members in attendance.

Deputy Mayor Queen read the following Land Acknowledgement:

We acknowledge the Three Fires Confederacy (Ojibwe, Potawatomie and Odawa) and the Traditional ancestral, unceded territory of Caldwell First Nation; the original people of Point Pelee, Pelee Island and its surrounding waters. We recognize and respect the First Nations who are stewards of the land and waters of Turtle Island and who have embraced this stewardship since time immemorial. We would like to acknowledge other nearby First Nations Communities and First Nations across Turtle Island.

Deputy Mayor Queen called for a moment of silence followed by the 2nd Cottam Scouts singing O'Canada.

Councillor DeYong added one Announcement.

Councillor Neufeld added one Announcement.

There were no disclosures of interest. Deputy Mayor Queen reminded Council that any declaration is to be made prior to each item being discussed and to identify the nature of the conflict, if any, as the agenda items come forward.

Deputy Mayor Queen introduced Alan Batke as 2022 Kingsville Citizen of the Year.

The Town Clerk invited Mr. Batke to the centre of Council Chambers to accept the recognition this evening from the Deputy Mayor and CAO.  Mr. Batke thanked Council for the honour and the opportunity. He commented that his volunteer work as well as maintaining his own flower garden has been a labour of love and that he'll continue to volunteer as long as he is able.

Emily Acheson, Resident on McCracken Road, presented her concerns as provided in the written submission in regard to specific issues with short-term rentals on McCracken Road, and general concerns regarding short-term rentals (AirBnBs) in Kingsville. She highlighted various sections of the current existing Comprehensive Zoning By-law of the Town, also as set out in the written submission and attachments.

She requested that Council consider requesting that the current zoning by-law be enforced, and also to implement a by-law to regulate short-term rentals, particularly when the hosts are not living at the property. 

The Town Clerk advised that Ms. Sorensen was not able to attend, having sent her regrets.

Pete Dewar, also a McCracken Road Resident, expressed concerns in regard to the AirBnBs in Town and on McCracken Road specifically. He commented that Lambton Shores has implemented a short-term rental by-law and that the Colchester area has several AirBnBs in operation. He implored Council to implement a by-law before AirBnBs become a huge problem, and commented that he doesn't want to see any existing short-term rentals grandfathered.

    1. That the closure of the following streets to vehicle traffic on November 19, 2022 for the Fantasy of Lights Parade BE APPROVED:

       

      • Jasperson Drive from Applewood Road to Road 2 East from 1:30 PM to 4:45 PM for Staging
      • Main Street from Jasperson Drive to the end of Division Street South from 4:45 PM to approximately 6:00 PM for the parade route
      • Park Street from Division Street to 103 Park St. (Grovedale Arts and Culture Centre) beginning at 6:00 PM to De-stage.

    1. That By-law 55-2022 being a by-law to amend By-law 83-2017 for a further extension of Part-lot Control exemption to allow Lots 46 to 49 (inclusive) on Plan 12M-598 to continue to be exempt from Section 50(5) of the Planning Act be taken as having been read three times and finally passed and the Deputy Mayor and Clerk be authorized to sign same.

    1. That an amending agreement for the provision of Police Services under Section 10 of the Police Services Act between His Majesty the King in Right of Ontario as represented by the Solicitor General (“Ontario”) and the Town of Kingsville BE EXTENDED for a period of one year ending December 31, 2023; and

       

    2. That By-law 57-2022 being a by-law to authorize the extension agreement be taken as having been read 3 times and finally passed and the Deputy Mayor and Clerk BE AUTHORIZED to sign same; and

       

    3. That Administration be DIRECTED to prepare a report for Council, before the expiry of this one year period, to provide recommendations with respect to contract enhancements and police facilities.

    That Council AUTHORIZE Administration to provide Hydro One Networks Inc. with approval to relocate hydro poles to accommodate the remaining phases of Road 2 East reconstruction from Graham Sideroad to Division Street North.

Councillor Lucier reminded of the upcoming 53rd annual Migration Festival commencing October 14, 2022.

Councillor Neufeld announced that the Communities in Bloom Committee is hosting their 3rd fundraiser dance on Friday, October 21 at The Grovedale and the 5th annual pumpkin parade will be held on November 1 at Lakeside Park.
